Below you will find some of the most frequently asked questions regarding the Monitor.

  • A Monitor is an Attorney General-appointed official whose job is to investigate and report on Rady’s compliance with all Competitive Impact Conditions and Equity Impact Conditions. Specifically, Condition XXIII provides that the Monitor shall have the following powers to the extent necessary to monitor Rady’s compliance: (1) to take complaints from Payors, Rady, or from the Attorney General; (2) to inspect records and compel disclosure of confidential documents subject to any demonstrated legally recognized privilege and appropriate confidentiality protections; (3) to interview witnesses; (4) to hire staff and experts; and (5) to make recommendations concerning enforcement, oversight, and surveillance to the Attorney General.

  • Condition I provides that the legal entities bound by the Conditions include Children’s Hospital of Orange County (CHOC), Children’s Hospital at Mission (CHOC at Mission), Children’s HealthCare of California, Rady Children’s Hospital – San Diego (RCHSD), Rady Children’s Hospital and Health Center (RCHHC) and any other subsidiary, parent, general partner, limited partner, member, affiliate, successor, successor in interest, assignee, or person or entity serving in a similar capacity.

    “CHOC” shall include the 334-bed general acute care hospital located at 1201 West La Veta Avenue, Orange, California, 92868 and any other clinics, laboratories, units, services, or beds included on the license issued to “Children’s Hospital of Orange County” by the California Department of Public Health (CDPH) and effective on April 23, 2024.

    “CHOC at Mission” shall include the 54-bed general acute care hospital, located within Providence Mission Hospital Mission Viejo, located at 27700 Medical Ctr. Rd., 5th Floor, Mission Viejo, California, 92691 and any other clinics, laboratories, units, services, or beds included on the license issued to “Children’s Hospital at Mission” by CDPH and effective on January 1, 2024.

    “CHC” shall include CHOC, CHOC at Mission, CHOC Foundation, a California nonprofit public benefit corporation, CRC Real Estate Corporation, a California nonprofit public benefit corporation, Providence Speech and Hearing Center, a California nonprofit public benefit corporation, Children’s Health Plan of California, a California nonprofit mutual benefit corporation, Orange County Medical Reciprocal Insurance Company, a Risk Retention Group, and Newport Language, Speech and Audiology Center, Inc., a California nonprofit mutual benefit corporation.

    “RCHSD” shall include the 507-bed general acute care hospital located at 3020 Children’s Way, San Diego, California, 92123 and any other community neonatal intensive care, perinatal intensive care or other pediatric care sites, clinics, laboratories, units, services, or beds included on the license issued to RCHSD by CDPH and effective on June 27, 2024.

    The Monitor does not have authority to investigate issues related to any other hospital or healthcare entity not affiliated with Rady Children’s Health.

  • No.  Condition XII provides that “[r]etaliation or threats of retaliation based on any Payor, entity, or individual having provided information in conjunction with these Conditions to any party, the Monitor (as defined by XXIII below), or a court is prohibited.”

  • This website is intended to educate all affected stakeholders regarding the Conditions, including patients and families, payors, state and local governments, employees, academic institutions, pediatric physician and surgeon trainees, other specialty trainees, and community members, and to provide a portal for potentially impacted individuals to contact the Monitor, so that the Monitor may investigate further, if appropriate.

  • The Monitor can address complaints related to Rady’s compliance with the Equity Impact Conditions and Competitive Impact Conditions, including that Rady is not complying with those Conditions, and may refer complaints to the California Attorney General’s Office.

    The Monitor does not have authority to investigate issues, concerns or conduct unrelated to the Equity Impact Conditions and Competitive Impact Conditions.

  • The Submit a Complaint link at the top of this page, or here will take you to a link that will permit you to input as much information as possible about a potential violation of the Equity Impact Conditions or Competitive Impact Conditions.  You may also upload any documents or materials related to your complaint.

    The Monitor does not have authority to investigate issues, concerns or conduct unrelated to the Equity Impact Conditions and Competitive Impact Conditions.

  • No, the Monitor will not provide information about your identity to Rady or CHOC, without your consent.  Further, Condition XII provides that “[r]etaliation or threats of retaliation based on any Payor, entity, or individual having provided information in conjunction with these Conditions to any party, the Monitor (as defined by XXIII below), or a court is prohibited.”

  • Yes, you can submit a complaint anonymously. The Monitor takes all complaints provided seriously and will attempt to investigate each complaint that the Monitor has the ability to address. However, without contact information or the ability for the Monitor to follow-up on the anonymous complaint, the Monitor may not be able to verify the information provided, or investigate and substantiate the complaint.

  • The Monitor will investigate each complaint submitted. Depending on the character, nature, and information provided, the Monitor may or may not seek to discuss the complaint with you shortly after you submit the complaint, if you provided contact information. However, the Monitor will investigate the complaints provided that it has the authority from the Attorney General to review. After its investigation, the Monitor will make a recommendation to the Attorney General regarding Rady’s compliance with the Equity Impact Conditions and Competitive Impact Conditions in light of the complaint.
